Motiland — Privacy Policy (Online Store)

This Privacy Policy explains how we process personal data when you shop at motiland.com (the "Store").

1. The short version

• We process your data mainly to produce and deliver your order and to handle payments and claims.
• Your model configuration (the place you chose, frame, engraving) is part of your order — we need it to manufacture your product.
• Marketing cookies (Meta, TikTok, Google) run only with your consent via the cookie banner.
• We don't sell personal data.

2. What we process and why

a) Orders and delivery — name, delivery and billing address, e-mail, phone, ordered items and your product configuration (selected map area, size, frame colour, engraving text, marker position), order and payment status, delivery information. Purpose: concluding and performing the purchase contract, production of your custom product, delivery, communication about the order. Legal basis: performance of a contract (Art. 6(1)(b) GDPR).

b) Payments — payment method and status. Card and wallet payments are processed by Shopify Payments and PayPal; we never see or store your full card number. Legal basis: performance of a contract; legal obligations (accounting).

c) Invoicing and accounting — invoicing data required by tax law. Legal basis: legal obligation (Art. 6(1)(c)); retention per tax rules.

d) Claims and support — communication with support, claim details and photos. Legal basis: performance of a contract; legal obligations (consumer law).

e) Marketing — with your cookie consent, advertising and analytics tools measure and improve our campaigns (see Section 5). If you are our customer, we may occasionally send you an e-mail about similar products; you can opt out anytime via the unsubscribe link (Art. 7(3) of Act No. 480/2004 Coll.; legitimate interest).

f) Store operation — technical logs, security, fraud prevention (via the Shopify platform). Legal basis: legitimate interests (secure operation).

3. Recipients and processors

Your data is shared only as needed to fulfil your order and operate the Store:

• Shopify International Ltd. (Ireland; part of the global Shopify group) — e-commerce platform hosting the Store, checkout, and payments (Shopify Payments).
• PayPal (Europe) S.à r.l. — if you pay with PayPal.
• Packeta / Zásilkovna s.r.o. — delivery of your order (receives name, address, phone, e-mail, COD amount where applicable).
• PINKTORA production systems — our internal order system, where your product configuration is stored for manufacturing.
• Advertising and analytics providers — Meta Platforms, TikTok, Google — only if you consent to marketing/analytics cookies (Section 5).
• Accounting and tax service providers — for statutory bookkeeping.

Where providers process data outside the EU (e.g., US entities of Shopify, Meta, TikTok, Google), transfers rely on the EU–U.S. Data Privacy Framework and/or Standard Contractual Clauses.

4. Retention

• Orders, claims, and related communication — 4 years after delivery (limitation periods and warranty claims).
• Tax documents (invoices) — 10 years (statutory retention).
• Product configurations — stored with the order as a production record; unpaid draft configurations are deleted within 90 days.
• Marketing e-mail — until you unsubscribe or object.
• Cookies — per your banner settings (Section 5).

5. Cookies and advertising pixels

The Store uses:

Analytics and marketing tools load only after you give consent in the cookie banner. You can change or withdraw your choice anytime via the cookie settings link in the Store footer. Withdrawal does not affect processing before withdrawal.

6. Your rights

Under the GDPR you have the right to access, rectification, erasure, restriction, data portability, and to object (including to marketing at any time). Contact support@motiland.com; we may need to verify your identity. You can also complain to the Úřad pro ochranu osobních údajů (uoou.gov.cz) or your local supervisory authority.

Please note: data we must keep by law (e.g., issued invoices) cannot be erased before the statutory period expires.

7. Security

Checkout and payments run on the Shopify platform with industry-standard encryption (TLS); card data is handled by certified payment processors (PCI DSS). Access to order data is limited to people who need it to fulfil your order.

8. Children

The Store is intended for persons aged 15+; purchases by younger persons require parental consent.

9. Changes

We may update this Policy; the current version is always at motiland.com. Material changes will be announced in the Store.
